Who are We?
The Utility Regulation and Competition Office (OfReg, the Office) is the independent multi sector regulatory body with responsibility for the Energy and Electricity, Fuels, Information and Communication Technology (ICT), and Water and Wastewater sectors. The Office maintains regulatory oversight for all utilities providers in the Cayman Islands.
OfReg has wide powers for consumer protection and is particularly mandated to facilitate innovation in the sectors for which it has responsibility for the promotion of economic development. OfReg enforces compliance for all licensees through the administration of penalties and fines as dictated by the Utility Regulation and Competition (URC) Act and the relevant sector acts and licenses.
1. JOB DESCRIPTION
1.1. Overview
The Regulatory Analyst – Fuels assists the Chief Fuel Inspector (CFI) in the monitoring and analysis of the fuel sector economic and commercial operations performance to support policy, strategic and tactical decisions relating to the sector.
1.2. Job Purpose
The post holder is responsible for collecting and assembling data required under the Dangerous Substances Act, the Fuels Market Regulation Act, and the URC Act and apply various analytical tools and technique to provide the CFI with statistical, economic and summary financial reports and recommendations in keeping with the mandate of the OfReg - Fuels Unit. The Regulatory Analyst – Fuels is also expected to compare regional and global trends in the oil and gas industry and perform basic policy evaluation and analyses to support OfReg’s policy. This post requires a high level of confidentiality in the handling of commercially sensitive and competitive information relating to the sector.
1.3. Scope of Role
The Regulatory Analyst – Fuels carries out their function with delegated authority by the CFI. The role is not a safety sensitive position but works in close collaboration with the Fuels Inspectors in the general administration of the Dangerous Substances Act and shall recognise that safety in the sector is a high priority and has a significant impact on the economic performance of the sector. In addition to analysis performed relating to the sector, the post holder will work with the Deputy Chief Fuels Inspector in managing the internal financial affairs of the OfReg - Fuels Unit. The full scope of the post applies to the entire Cayman Islands.
1.4 ACCOUNTABILITIES
Regulatory, Economic, and Competition Analysis
1. Obtain and assemble database utilising agreed and established format, all information related to Section 10A of the Dangerous Substances Act and any other information as requested by CFI.
2. Analyse the flow of cost in the fuel sector supply chain with greater emphasis on the Refinery-to-End Users (consumers) segment.
3. Measure and track key indicators agreed upon relating to the overall sector and individual entities within the sector, including but not limited to margins analysis, profitability, inventory management and stock turnover, asset utilisation, investment pipeline, pricing mechanism/structure, economic performance of utility vs. non-utility fuels streams, fuel and non-fuel revenues impacts, economic indicators such as computed ROCE and ROI, and other established and /or bespoke measures and indicators of market efficiency, competitiveness and reliability.
4. Prepare reports on the foregoing duties for submission to the Board of Directors through the CFI.
5. Make recommendations for improvement in the monitoring and oversight of the economic performance of the sector.
6. Assist with reviewing financial reports received from Importers and Operators in the Wholesale and Retail sub-sectors.
7. Assist in collecting and analysing data on pricing information and market operation for regional and other relevant extra-regional jurisdictions in comparison to Cayman Islands. Emphasis to be placed on the diverse and varied tax and other regulatory mechanisms in place for the various jurisdictions.
8. Assist with researching the impact of varying price models and
regulatory regime on end prices.
9. Assist in the analysis and report on annual, quarterly and monthly
financial and statistical reports received from Importers (and certain categories of Operators).
Regulatory Reporting
1. Assist the CFI with the compilation of materials and other documents for presentation to Ministry, Cabinet or other forums as required.
2. Assist with collating and tabulating other information relevant to the wider OfReg operation and performing statistical analysis on the data compile for presentation.
3. Assist with matters of the Dangerous Substances Board Fuel Advisory Committee and Fuel Standards Committee which include preparation of documents meetings (including subcommittee meetings), taking and producing meeting minutes in a timely manner, economic analysis of proposals, consultancy and any other matters as requested by Assistant Director.
4. In collaboration with the Economics and Statistics Office, Customs and Border Control and other relevant agencies facilitate the sharing of information permitted under the various Acts to facilitate a comprehensive review and understanding of the economic and commercial operation of the fuel sector.
5. Maintain appropriate document filing in accordance with the National Archives and Public Records Act and OfReg policies and procedures.
6. Exercise powers of enforcement in cases of non-compliance
where necessary under the delegated authority of the CFI.
General
1. Assist the team with general customer service support such as complaint handling and responding to Freedom of Information request through OfReg’s Information Manager.
2. Assist the CFI with management of OfReg’s budget and support efforts related to procurement, account receivable, accounts payable and other business-related transaction activities in collaboration with the Accounts Team.
3. Meaningfully participate in projects of national significance providing sound analytical input and support relative to the trends and practices in the fuel industry. This includes commissioning of special research and studies, and networking where possible to obtain relevant information to guide policy makers in policy decisions.
4. Support the review and implementation of OfReg processes, policies and procedures.
5. Assist with ensuring the technical assets of the fuels function, including but not limited to radars and calibration equipment are adequate and properly maintained.
6. Support OfReg - Fuels Unit where practical in Emergencies and
Emergency response efforts.
7. From time to time, in the absence of the Deputy, undertake assigned responsibilities of Assistant office.
8. Perform other duties/tasks assigned from time to time by the CFI.

1.5. Assignment & Planning of Work
In general, the work assignments for the Regulatory Analyst – Fuels fall within the delegated authority of the CFI. The post holder will function in accordance with the principal accountabilities highlighted above and execute tasks and deliverable on the instruction of the CFI.
The post holder is part of a team, working directly with the Senior Management team and is required to demonstrate a high level of initiative in respect to dealing with conflicting responsibilities and deadlines.
1.6. Supervisory Responsibilities & Key Working Relationships
There are no supervisory responsibilities with this position, however the post holder may be assigned leadership responsibilities for specific projects. The post holder will have daily working relationship with senior managers, together with all OfReg’s employees, interns, and consultants. They are also directly responsible for ensuring that good business relations are maintained with all licensees, as well as Central Government and other Authorities and Government Companies.
1.7. Decision Making Authority & Controls
The post holder shall function pursuant to authority delegated by the CFI under The Dangerous Substances Law and any other delegation issued in writing, that is relevant to the post as determined to be applicable by the CFI.
1.8. Working Conditions
Normal office working conditions apply; in addition to flexibility and the ability to work outside normal working hours, 8:30am – 5:00pm from time to time. A considerable amount of time will be spent viewing a computer.
The position is office based, however will involve visits to entities occasionally to verify and validate information and meet with personnel to address and resolve matters which may arise.
